Foreign workers are required to undertake dactyloscopic registration and medical examinations; who is required to undergo them, where they must be performed, and within what timeframes?

Beginning on December 29, individuals from other countries who enter Russia are forced to go through a dactyloscopic registration process, as well as a necessary medical checkup and picture. Who specifically needs to have a dactyloscopy and a picture taken?

All foreigners are required to undergo dactyloscopy and photography, with the following exceptions: members of the population of the Republic of Belarus;
• children who are less than six years old, regardless of whether or not they are citizens of another country.

As a result of the fact that the obligation is written down in the law titled "On the Legal Status of Foreign Citizens in the Russian Federation," which governs the temporary stay of foreigners, it is reasonable to assume that the obligation will not apply to foreigners who are temporarily residing and permanently residing in Russia (those who have obtained RVP or residence permit).

It will only be necessary to do dactyloscopy and photography once, but it will be done in a variety of different methods for various groups of foreigners.

In accordance with the general concept, those who enter Russia with the intention of obtaining work are required to submit an application for dactyloscopic registration and photography to the migration подраздeление within a period of thirty days from the date of their admission into Russia. In the event that there is a branch of the Federal State Unitary Enterprise PVS of the Ministry of Internal Affairs of Russia in the area, then to that branch; moreover, to the MMC "Sakharovo" in Moscow.

It is the method that will be carried out when an application for the issuing of a patent is submitted by those individuals who are successful in obtaining patents.

In line with Article 13.5 of the legislation titled "On the Legal Status of Foreign Citizens in the Russian Federation," the process will be carried out when the work permit is received by those who have obtained a work permit within the category of highly skilled specialists or key people.

Beginning on December 29, foreign highly qualified professionals and important individuals who are presently working in Russia are required to go through the process following their first arrival into the country. During the process of getting the "plastic," those who will be undergoing ophthalmoscopic examination for the very first time are subjected to dactyloscopy and photography.

Who is required to go through a medical examination?

In order to go through with dactyloscopy, it is required to pass the medical examination and provide the findings of the examination.

As of the 31st of October in 2021, a mandatory medical examination for foreign residents was implemented; however, this requirement is only applicable to visa foreigners and highly skilled foreign professionals who visit Russia in order to secure a work permit. In other words, they have been granted a work permit, they have secured a work visa, and they have entered the country in order to get the "plastic" and continue working. It is in this circumstance that foreigners are required to have a medical examination within thirty calendar days of the date that they entered Russia. On the other hand, if they entered the country before to December 29th, these foreigners are exempt from having to undergo dactyloscopy.

Beginning on December 29, all foreign nationals entering Russia are required to undergo a medical examination, with the exception of those who possess a valid medical conclusion and a certificate stating that they do not now have HIV infection. Foreign nationals who have recently gotten a patent or visa foreign nationals who have received a work permit (not highly trained professionals), left Russia, and subsequently re-entered the country, but already after December 29 are examples of individuals who fall into this category. The necessary medical records are needed to be presented in order to get the permission paperwork for each of these situations. Because of this, it is not necessary to have a medical examination within the term of validity of medical papers, even upon fresh admission into Russia, even after the 29th of December. The medical conclusion and the certificate of absence of HIV infection both have a validity span of three months until they are no longer valid.

In the event that foreign workers who are already in Russia but do not possess valid medical documentation leave the country for the holidays of New Year or Christmas and then return to Russia (already in January), it is obligatory for them to undertake a medical examination.

What is the location of the medical examination, and where should the findings be submitted?

The only medical organizations that are permitted to conduct medical examinations are those that are listed on the list that is authorized in each location. As an example, the Resolution of the Government of Moscow dated 28.09.2021 No. 1517-PP "On establishing lists of medical organizations in accordance with the Federal Law of July 25, 2002 No. 115-FZ 'On the Legal Status of Foreign Citizens in the Russian Federation'" is the one that has given its approval to such a list. An examination is performed to determine whether or not the individual has used drugs and whether or not they have any infectious illnesses such as TB, leprosy, syphilis, COVID-19, or HIV infection.

Medical examination must not only be completed within 30 calendar days from the date of entry into Russia but also, within the same 30 calendar days from the date of entry, must be personally submitted to a branch of the Federal State Unitary Enterprise PVS of the Ministry of Internal Affairs of Russia (throughout the country) or MMC “Sakharovo” (in Moscow in particular). In places where there are no branches of the Federal State Unitary Enterprise PVS of the Ministry of Internal Affairs of Russia, the papers will be approved by migration подразделения.

In the event that a foreigner is in Russia at the time when the validity term of their medical papers is about to expire, they are required to undergo medical examination once again within a month of the date that the documents expire, and this obligation is repeated each time.

The foreigner is required to undertake a medical examination within thirty days of the date of arrival into Russia if they are travelling outside of Russia at the time when the validity term of their medical documentation is about to expire, which is thirty calendar days after the end of the validity period.

Those foreign nationals who are not planning to leave the country are exempt from having to go through a medical examination, and they will not be obliged to do so until their first departure and admission into the country.
